NOTICE TO THE ATTORNEY-GENERAL AND THE VICTORIAN EQUAL OPPORTUNITY AND HUMAN RIGHTS COMMISSION UNDER THE CHARTER OF HUMAN RIGHTS AND RESPONSIBILITIES

  1. The Plaintiff gives notice that—

in the case of Kant v. The Commissioner of the Australian Federal Police & Anor—
a question of law arises that relates to the application of the Charter of Human Rights and Responsibilities (“the Charter”).

  1. May writ of habeas corpus issue on a ground of unlawfulness arising because of the Charter?
  2. The Plaintiff is subject to (intendedly-)covert experimentation by persons appearing (to him) to be connected to government, and believes that the same processes used in attempt to covertly experiment with him also have the effect of restraining him.

(Intendedly-)covert experimentation, such that has involved gathering of information with apparent potential to bear prejudicially on the Plaintiff’s interests, continues despite the Plaintiff having made known his awareness of it — this is incompatible with a “human right” to freedom from cruel or inhuman treatment or punishment.

  1. The application will be heard at a place and time yet to be fixed under Rule 57.02(2) of the Supreme Court (General Civil Procedure) Rules 2015.
